Regeringen fremsætter lovforslag om solceller

Regeringen har i dag sendt et lovforslag i høring, der skal begrænse et forventet afgiftstab i statskassen fra 4,9 mia. kr. til 3,7 mia. kr. frem mod 2030, fordi udbygningen af solceller ser ud til at stige til 1.350 MW i 2020, hvilket er markant over den politisk aftalte ramme for udbygning med solceller på 918 MW i 2020. Lovforslaget fremsættes tirsdag d. 23. maj. Regeringen arbejder på en løsning til den langsigtede håndtering af solcelleudbygningen i Danmark.

Lovforslag skal begrænse stort afgiftstab i statskassen
Udbygningen med solceller forventes at gå hurtigere end forventet i de gældende politiske aftaler på området, hvor der er aftalt en ramme på 918 MW ny solcellekapacitet i 2020. Med de seneste prognoser fra Energistyrelsen og Energinet.dk er forventningen, at udbygningen stiger til 1.350 MW i 2020, hvilket risikerer at skabe et stort afgiftstab i statskassen på 4,9 mia. kr.

Det skyldes, at el fra solceller, der produceres ”bag elmåleren” og forbruges direkte af producenten, er fritaget for at betale afgifter, PSO, moms og i et vist omfang også nettariffer. Dermed kan husstande, boligforeninger og virksomheder med solceller få en indirekte støtte ved at spare afgifter, der så mangler i statskassen.

For at begrænse afgiftstabet for statskassen og sikre klarhed om rammevilkårene for solceller fremsætter regeringen på tirsdag d. 23. maj et lovforslag.

”Udbygningen af solceller i Danmark kan komme til at gå for stærkt, og vi ser ud til at få langt flere solceller, end vi har aftalt politisk. Det er ikke hensigtsmæssigt. Dels er udbygningen ufinansieret og vil slå et gedigent hul i statskassen på knap 5 mia. kr. Dels sker udbygningen ved, at mange husstande og virksomheder sætter solceller på taget til egetforbrug. Det er en meget dyr måde for statskassen at få el fra solceller på i forhold til eksempelvis statslige udbud af større projekter, hvor formålet alene er at producere mest mulig grøn strøm til elnettet til laveste budpris. Vi har ikke ramt isbjerget endnu, men det gør vi, hvis vi ikke gør noget nu. Derfor udviser vi rettidig omhu og strammer reglerne med dette lovforslag,” siger energi-, forsynings- og klimaminister Lars Chr. Lilleholt (V).

Lovforslaget betyder, at ”timebaseret nettoafregning” af elafgift afskaffes og erstattes med ”øjebliksafregning”, således at elektricitet leveret til det kollektive net ikke længere kan modregnes i elektricitet hentet fra det kollektive net, når afgiftsbetalingen opgøres. Øjebliksafregning indebærer, at der betales elafgift på almindelige vilkår for alt forbrug af elektricitet, som leveres fra det kollektive elnet. Øjebliksafregning sikrer således, at ejere af solcelleanlæg afgiftsmæssigt ligestilles med elforbrugere uden solcelleanlæg i forhold til den elektricitet, som leveres fra det kollektive net.

Den elektricitet, der forbruges direkte fra en anlægsejers samtidige egenproduktion (dvs. uden ”lagring” af den producerede elektricitet på det kollektive elnet), vil med øjebliksafregning fortsat være fritaget for betaling af elafgift mv.

Lovændringen vil begrænse det forventede afgiftstab med ca. 1,2 mia. kr., således at afgiftstabet forventes at blive reduceret fra 4,9 mia. kr. i 2030 til 3,7 mia. kr. i 2030. Solcelleudbygningen forventes at blive begrænset med 135 MW til i størrelsesordenen 1.215 MW i 2020, og vil således stadig ligge over den politisk aftalte udbygning.

Regeringen arbejder på langsigtet løsning
Den store solcelleudbygning er i høj grad drevet af den nuværende afgifts- og tilskudsstruktur, der gør det økonomisk fordelagtigt at opstille solceller til egetforbrug og dermed undgå at betale afgifter.

Til efteråret vil regeringen fremlægge et udspil til en ny energiaftale, og der vil blive set på mulighederne i afgifts- og tilskudssystemet.

”Det kan komme til at gå for hurtigt med en solcelleudbygning, der drives frem af, at folk kan spare en masse penge ved ikke at skulle betale afgifter. Det er jo rart for den enkelte solcelleejer, men det er ikke hensigtsmæssigt, at naboen og alle andre skal dække hullet i statskassen. Derfor skal vi have gjort noget ved afgifts- og tilskudsstrukturen på energiområdet, så vi får mest muligt grøn omstilling for pengene og skaber langsigtede og stabile rammevilkår for branchen og investorerne,” siger energi-, forsynings- og klimaminister Lars Chr. Lilleholt (V).

Fakta om lovforslaget


Med lovforslaget afvikles timebaseret nettoafregning af elafgift, og der indføres i stedet øjebliksafregning.
For anlæg på timebaseret nettoafregning betales der ikke elafgift for elektricitet, som egenproducenten producerer og nettoforbruger fra el-nettet inden for en time.
Afviklingen skyldes, at der ventes markant flere solcelleanlæg, end der er afsat finansiering til med de energipolitiske aftaler.
Eksisterende husholdninger med anlæg på højest 6 kW vil med lovforslaget fortsætte på timebaseret nettoafregning indtil 2032.
Nye anlæg og eksisterende erhvervsanlæg vil imidlertid overgå til øjebliksafregning.

Det lyder som nogle voldsomme tal. Har ikke selv fakta checket dem, men det forslag der citers fra omtaler timeafregning gr. 2 og den ordning er der vel egentlig ikke ret mange der er på i virkeligheden. De fleste private på timeafregning er nok på den forsimplede gr. 4. da den ikke kræver øget abonnement og målerafgift, og her afregnes også ligesåsnart strømmen er ude på nettet.
Totalt set er der nok flest private husstands anlæg i gr. 5 (årsbaseret) herefter gr. 4 og sidst gr. 2.
Men der kan selvfølgelig være en del "private" anlæg ejet af "solcellebaroner" som er årsag til den ekstraordinære hurtige udbygning, for jeg tror ikke det er private husstandsanlæg, betalt med egenopsparing (efterløn) der bliver etableret lige for tiden, og frem til 2020.
